Refund Policy
1. General Policy
LumivantaTechnologies operates on a milestone-based payment system. Refunds are evaluated based on the stage of project completion and the specific terms outlined in the individual service agreement.
2. Pre-Development Cancellation
If a project is cancelled before any development work has commenced, a full refund of any advance payment will be issued within 14 business days, minus any administrative processing fees (maximum 5% of the transaction value).
3. In-Progress Projects
For projects cancelled during active development: (a) Payment for completed milestones is non-refundable; (b) Partial work product will be delivered to the client; (c) Outstanding milestone payments are waived upon cancellation confirmation.
4. Delivered Services
Once a service has been fully delivered and accepted, refunds are not available. Defects or bugs reported within 30 days of delivery will be addressed at no additional cost under our quality assurance guarantee.
5. Refund Process
To request a refund, contact [email protected] with your project reference number. Refunds are processed via the original payment method within 14 business days of approval.
6. Dispute Resolution
Any disputes regarding refunds shall first be addressed through direct communication. If unresolved, disputes may be submitted to the jurisdiction of Madrid, Spain, in accordance with applicable Spanish consumer protection legislation.
Terms of Service
1. Acceptance of Terms
By engaging the services of LumivantaTechnologies, located at Calle Santa Áurea 36, Piso 2 B, Madrid, Spain, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between the client and LumivantaTechnologies.
2. Scope of Services
LumivantaTechnologies provides web engineering services including automated web application development, custom merchant configurations, high-performance software block construction, and web scaling architecture. Specific deliverables, timelines, and pricing are defined in individual service agreements.
3. Payment Terms
(a) Payments are processed via Stripe payment links provided through our platform; (b) Milestone payments are due upon completion of each defined phase; (c) Late payments may incur a 2% monthly interest charge; (d) All prices are quoted in EUR and include applicable taxes unless otherwise stated.
4. Intellectual Property
Upon full payment, the client receives full ownership of all custom-developed code, designs, and deliverables. LumivantaTechnologies retains the right to use general methodologies, frameworks, and non-proprietary techniques developed during the project for future engagements.
5. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives the termination of the service agreement for a period of 24 months.
6. Limitation of Liability
LumivantaTechnologies' total liability shall not exceed the total amount paid by the client for the specific service giving rise to the claim. We shall not be liable for indirect, incidental, or consequential damages.
7. Force Majeure
Neither party shall be liable for delays or failures in performance resulting from causes beyond reasonable control, including natural disasters, pandemics, government actions, or infrastructure failures.
8. Governing Law
These terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Madrid, Spain.
9. Modifications
LumivantaTechnologies reserves the right to modify these terms at any time. Continued use of our services after modifications constitutes acceptance of the updated terms.
